Welcome to Brick Now. These Terms of Service ("Terms") govern your access to and use of our website (the "Site") and the purchase of our custom brick mosaic products (the "Services"). By accessing our Site or clicking "Place Order," you agree to be bound by these Terms and our Returns & Refund Policy.

1. Acceptance & Digital Signature

Age Requirement: By using this Site, you represent that you are at least 18 years of age. If you are under 18, you may only use this Site under the supervision of a parent or legal guardian.
Binding Agreement: You acknowledge that your electronic action of purchasing constitutes a legally binding electronic signature. If you do not agree to these Terms, please do not use our Services.

2. Intellectual Property & User Content

Ownership: All content on this Site, including the Brick Now logo, proprietary mosaic conversion algorithms, and design layouts, is our exclusive property.
User Responsibility: You represent that you own or have obtained all necessary permissions for any image you upload. Brick Now acts as a passive provider of custom manufacturing services and disclaims any liability for copyright infringement arising from user-uploaded content.
Indemnification: You agree to indemnify Brick Now against any third-party claims or legal fees arising from your infringement of intellectual property rights. We reserve the right to refuse service for images that clearly violate copyright laws.

3. Product Representation & Liability

The "Mosaic Nature": You acknowledge that the product is a "Mosaic Representation." Due to the pixelated nature of brick art, fine details will be simplified. This is an inherent characteristic of the art form and not a manufacturing defect.
Color Disclaimer: We do not guarantee a 100% color match due to the technical discrepancy between backlit digital screens (RGB) and physical plastic pigments.
Safety Warning: Products contain small pieces. By purchasing, you agree to keep them away from children under 3 years old. Brick Now is not liable for choking accidents or misuse.

4. Pricing, Payment & Currency

Pricing: All prices are subject to change without notice. Prices may not include VAT, sales tax, or import duties, which are the sole responsibility of the customer.
Currency: All transactions are processed in USD. Brick Now is not responsible for any currency conversion fees or exchange rate fluctuations applied by your financial institution.
Chargeback Policy: You agree to contact hello@brick.now before initiating a bank chargeback. Fraudulent chargebacks will be reported to global fraud blacklists.

5. Shipping, Customs & Force Majeure

Transfer of Title: Title and risk of loss pass to you upon delivery to the carrier. You are the "Importer of Record" for all customs purposes.
Force Majeure: We are not liable for delays or fulfillment failures caused by natural disasters, strikes, pandemics, customs inspections, or global logistics disruptions.

6. Limitation of Liability

To the maximum extent permitted by law, Brick Now and its parent company, directors, and employees shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the amount paid by you for the specific order in question.

7. Privacy & Data Use

Your use of the Site is also governed by our Privacy Policy. Specifically, you consent to our temporary storage and processing of your uploaded images solely for fulfillment and after-sales support.

8. Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.
Informal Resolution: You agree to first contact Brick Now at hello@brick.now to seek an informal resolution for at least 30 days before initiating any formal proceedings.
Mandatory Arbitration: Any dispute that cannot be resolved informally shall be referred to and finally resolved by binding arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC). The language of arbitration shall be English.
Class Action Waiver: All dispute resolution proceedings will be conducted only on an individual basis. You hereby waive your right to participate in a class-action lawsuit, collective litigation, or mass claim against our brand.
